By accessing, browsing, or purchasing from cariette.com (“Site”, “we”, “us”, “our”), you (“Customer”, “you”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use this Site.

1. ACCEPTANCE & UPDATES

1.1 These Terms govern your use of the Site and all transactions.
1.2 We may revise these Terms at any time. The updated version will be posted here with a new effective date. Your continued use constitutes acceptance.
1.3 We recommend reviewing these Terms periodically before each purchase.

2. ELIGIBILITY & ACCOUNT

2.1 You must be at least 18 years old or have legal parental/guardian consent to make purchases.
2.2 You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
2.3 You agree to provide accurate, current, and complete information during checkout. False information may result in order cancellation or account suspension.

3. PRODUCTS & DESCRIPTIONS

3.1 We retail fashion accessories including bags, watches, jewelry, and decorative items (“Products”).
3.2 Product images, colors, materials, and finishes are displayed as accurately as possible. Minor variations may occur due to screen calibration, lighting, or manufacturing batches.
3.3 Jewelry & Watch Disclaimers:

  • Water resistance ratings (if stated) are laboratory-tested under controlled conditions and do not cover hot water, steam, chemicals, or prolonged exposure.
  • Some alloys may contain trace metals that can cause skin sensitivity. We recommend consulting a dermatologist if you have known metal allergies.
  • Normal wear, scratches, plating fading, and battery depletion are not manufacturing defects.
    3.4 We reserve the right to modify, discontinue, or limit quantities of any Product without notice.

4. PRICING, TAXES & PAYMENT

4.1 All prices are displayed in USD and are subject to change without notice. Prices exclude applicable sales tax, VAT, GST, customs duties, and import fees.
4.2 We accept Visa, Mastercard, PayPal, Apple Pay, Google Pay. Payment is authorized at checkout and captured upon shipment.
4.3 If payment fails, is declined, or flagged by fraud prevention systems, we may cancel the order and notify you.
4.4 You are responsible for any currency conversion, bank, or payment gateway fees.

5. ORDERS & ACCEPTANCE

5.1 Placing an order constitutes an offer to purchase. We accept your offer only upon sending an Order Confirmation email with a tracking number.
5.2 We may cancel or refuse any order for reasons including pricing errors, suspected fraud, inventory unavailability, or violation of these Terms.
5.3 In compliance with the FTC Mail, Internet, or Telephone Order Merchandise Rule, we will ship orders within the timeframe stated on the product page or checkout. If we cannot meet this timeframe, we will notify you and offer cancellation or revised delivery.

6. SHIPPING, DELIVERY & CUSTOMS

6.1 All orders are fulfilled and shipped from China to international destinations.
6.2 Processing Time: 1–3 business days. Transit Time: Typically 7–21 business days, depending on destination and carrier.
6.3 Shipping Terms: DAP (Delivered At Place). Risk of loss or damage transfers to you once the carrier takes possession of the package.
6.4 Customs & Import Responsibilities:

  • You are solely responsible for all customs clearance, import taxes, duties, VAT/GST, and brokerage fees.
  • Packages may be inspected, delayed, or held by customs authorities. We are not liable for customs-related delays, seizures, or refusal of entry.
  • Please verify local import regulations for jewelry, watches, or restricted materials before purchasing.
    6.5 Tracking information will be emailed when available. Delivery is not guaranteed and may be affected by force majeure events (e.g., weather, strikes, pandemics, carrier disruptions).

7. RETURNS, REFUNDS & EXCHANGES

7.1 You may request a return within 30 calendar days of confirmed delivery.
7.2 Eligible items must be unused, unworn, unaltered, in original packaging, and with all tags/seals intact.
7.3 Non-Returnable Items: Pierced jewelry (hygiene reasons), personalized/custom orders, final sale items, and products showing wear, damage, or missing components.
7.4 Return shipping costs are borne by the Customer, unless the item is defective, incorrect, or damaged upon arrival. We do not provide prepaid return labels for international shipments unless otherwise stated.
7.5 Upon receipt and inspection, refunds will be issued to the original payment method within 7–10 business days. Shipping fees are non-refundable.
7.6 Limited Warranty: Watches and jewelry carry a 12 -month warranty against manufacturing defects. Warranty does not cover normal wear, misuse, water/chemical exposure, battery replacement, or unauthorized repairs.

8. INTELLECTUAL PROPERTY

8.1 All content on this Site (logos, text, images, designs, software, trademarks, brand names) is the exclusive property of cariette.com or its licensors.
8.2 You may not reproduce, distribute, modify, scrape, or commercially use any Site content without prior written consent.
8.3 Third-party trademarks or brand references are used solely for identification and do not imply affiliation or endorsement.

9. USER RESPONSIBILITIES & PROHIBITED CONDUCT

You agree not to:

  • Use the Site for fraudulent, unlawful, or commercial resale purposes without authorization.
  • Submit false information, manipulate pricing, or exploit system vulnerabilities.
  • Upload malware, engage in scraping, or interfere with Site security or functionality.
    Violation may result in immediate account termination and legal action.

11. GOVERNING LAW & DISPUTE RESOLUTION

11.1 These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles.
11.2 Any dispute arising from these Terms or your use of the Site shall first be resolved through good-faith negotiation. If unresolved within 30 days, either party may submit the dispute to binding arbitration administered by JAMS / AAA in New York City, New York, or to the exclusive jurisdiction of the state or federal courts located in New York County, New York.
11.3 You waive any right to class actions or jury trials, where permitted by applicable law. Mandatory consumer rights in your country of residence (e.g., EU, UK, Australia) shall not be waived.
11.4 The prevailing party in any dispute may recover reasonable attorney’s fees and costs.
